 TERMS AND CONDITIONS

Nissan Sports and Social Club

These conditions apply to all contracts for the provision of goods and services by  (“Club”) for  group bookings (“the Services”)  ( including room hire,, and catering events functions or catering or any combination of these services)to the exclusion of all other terms and conditions.

1.                Meetings, and events

1.1.   Confirmations

 1.1.1.      Bookings will be treated as provisional until written confirmation is sent by the Customer to the Club.. The Club will then acknowledge receipt of the Customer’s confirmation at which point the contract will become binding and the booking confirmed. The Club may release provisional bookings.

 1.1.2.      The Customer must advise the Club in writing of the anticipated number of guests attending at the time of confirming the booking.

 1.1.3.      Final numbers must be given in writing to the Club at least 7 days before the event. The amount payable by the Customer will be calculated on the greater of this final number or the number who actually attended unless the booking is accepted by the Club on the basis that a minimum number of persons will attend the function, in which case the amount payable shall be calculated on the greater of such minimum number or the number actually attending.

 1.2.   Cancellations

 

1.2.1.      Should the Customer have to cancel the booking, a charge may be made, calculated as a percentage of the total booking value (including without limit the cost of room and food and beverages), according to the scale highlighted below:

 Between 6 weeks -3 months prior to the event  50%

 6 weeks prior to the event                     100%

 1.2.2.      All cancellations should be confirmed in writing by the Customer.  The Club may treat a postponement as a cancellation.

 1.2.3.      Cancellation charges will only be charged to the Customer to the extent that the Club is unable to mitigate its loss. Any costs incurred for a particular event, that otherwise would not have been incurred, will be charged in the event of cancellation.

 1.2.4.      The Club may cancel a booked event if the Customer is more than 30 days in arrears with any payments due to the Club or the Club becomes aware of a deterioration in the Customer’s financial ability to pay for the event or the event may prejudice the reputation of the Club.

 1.3.   Reduction in Numbers

 1.3.1.      Provisional numbers are required upon booking and the Club reserves the right to set a minimum number to be charged for the event.

 1.3.2.      Any reduction in numbers in the last 28 days before the event will be charged at 50% of the agreed individual rate, unless the "minimum number charged" is applicable.

1.4.   Deposits and Payment

 1.4.1 A minimum deposit of £100 payable within 7 days of enquiry to secure a reservation date.  The Club reserves the right to require payment of a deposit or deposits at any time before the start of an event. 50% of any such deposit is payable within 7 days of the Club’s request and the remaining 50% is payable 7 days prior to the event.  Should the Customer fail to pay such deposit within of the specified timeframe the Club may treat the booking as cancelled by the Customer in which event cancellation charges may apply. The deposits and payments made thereafter shall be non-refundable.

 1.4.2    Unless a credit sale invoice has been issued full payment will be required before the event (e.g. wedding receptions). The amount as invoiced must be received on the earlier of the date set out on the invoice or 7 days prior to the event, failing which the Club may cancel the booking.

 2.                  Credit

 Credit facilities may be obtained on application to and at the discretion of the Club. Applications take at least 14 days to process. Credit accounts will be invoiced immediately after the event.

 3.                  Interest

 Interest on overdue balances shall accrue from the date when payment becomes due, on a daily basis, until the date of payment, at a rate of 4% above Barclays Bank PLC’s base rate in force at the time and shall accrue at such a rate after, as well as before any judgement.

 4.                  Damage

 The Customer is responsible to the Club for any damage caused to the allocated rooms or the furnishings, utensils and equipment therein or to the Club generally by any act, default or neglect of the Customer, subcontractor, employee or guests of the Customer and shall pay to the Club on demand the amount required to make good or remedy any such damage. Customers may wish to take out their own insurance.

  5.                  Conduct of Customers and Guests

 No wines spirits or foods brought into the Club may be consumed without the consent of the Club. The Club has the right to approve any promotional material relating to the provision of the servcies and its name or logo may not be used without its prior written consent. The Club reserves the right to ask guests to leave or to terminate the provision of the Services, without refund, if there is any failure to correct (when asked) any aspect of poor behaviour or unacceptable activities on the part of any guest. The decision of the Club Manager is final.

 6.                  Price and Price Variations

All prices are quoted inclusive of VAT at the standard rate (currently 15%).  In the event of circumstances beyond the Club’s control (e.g. increases in the standard rate of VAT), the Club may vary the prices quoted to an extent which reflects such changed circumstances.

 7.                  Statutory Regulations

Customers must observe statutory regulations affecting the Club for example relating to music, dancing and entertainment covering all events held in Clubs. Customers shall maintain free access to fire exits at all times. Customers shall observe all regulations and observe directions relating to the conduct of their event which may notified to them at any time by the Club Manager.

 8.                  Guests’ Property

Any goods deposited in the cloakrooms or otherwise left unattended on Club premises are deposited at the owner’s risk. The Club does not accept any liability for loss or damage to any item of guest property while at the Club.  Guests should be able to take out appropriate insurance.

9.                  Professional Bodies and Performing Rights

 The Club reserves the right to approve the employment by Customers and guests of any photographer, musician or other persons in connection with any event and will without obligation be pleased to advise Customers in this regard. It shall be the responsibility of the Customer to ensure that, where applicable, Performing Rights Society forms and Phonographic Performance Limited forms are completed by any band or musicians employed by the Customer.

 10.              General Liability

 10.1.1.           Club shall not be liable, whether in contract, tort or otherwise for any indirect, consequential or economic losses (such as loss of profits, loss of opportunity, inconvenience or injury to feelings) howsoever arising (including negligence).

 10.1.2.           In no event will the Club’s liability for any loss or damage in contract or tort (including negligence) or howsoever otherwise, exceed the total amount paid to the Club by the Customer for the booking.

 10.1.3.           The Club does not hereby exclude or restrict its liability in respect of death or personal injury resulting from its negligence.

 10.1.4.           The Club shall not be liable for any breach of the terms and conditions or delay or failure in providing its Services as a result of causes beyond its reasonable control.

 11.              General

 a)      This contract shall not be assignable by the Customer, but may be assigned by the Club.

 b)     These terms shall be governed by and construed in all respects in accordance with the Laws and Courts of England and Wales.

 c)      It is the Club’s aim to provide the Customer with the service they have requested for their function, but in the unlikely event that the Club for any reason need to change any aspect of the function, they reserve their right to do so at any time. The Club will notify the Customer immediately when this happens and will use reasonable endeavours to provide alternatives of an appropriate and similar standard.
